RELEASE AND WAIVER OF LIABILITY
________________________ (the "Participant"). I, the Participant, hereby freely and voluntary, without duress, execute this Release under the following terms: 1. Waiver and Release. I hereby release and forever discharge and hold harmless Bob Kahn from any and all liability, claims, demands, and causes of action, of whatever kind of nature, either in law or equity, which may hereafter arise from my participation in The Cape Cod Friends/meetup.com Bicycle Riding Group (the "Program"). I understand and acknowledge that this Release discharges Bob Kahn from any liability or claim that I may have against Bob Kahn (including its successors and assigns), with respect to any bodily or other injury, illness, death, or property damage that may result from my participation in the Program. I also understand that Bob Kahn does not assume any direct or indirect responsibility or obligation to provide financial assistance or any other assistance, including, but not limited to, medical, health, or disability insurance, in the event of injury, illness, death, or property damage. 2. Assumption of Risk. I am fully aware of the requirements of Bicycle Safety Procedures and understand that my participation in the Program will include travel to the Program location, participating in the Program at the Program location, as well as other activities that may involve risk to me. I hereby expressly and specifically assume the risk of injury or harm in the activities related to the Program and release Bob Kahn from any and all liability for injury, illness, death, and/or property damage that may result for all time. 3. Other. I expressly understand and agree that this Release is intended to be as broad and inclusive as permitted by law, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Massachusetts. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release. 4.Obey all Traffic Rules I agree to wear a Bicycle Helmet at all times while riding in the Program and also agree to follow all rules of the road as they apply to Bicycle Riders/Riding as established by the state of Massachusetts.
